Why the Quality of Drafting Matters

A prenuptial agreement that isn’t properly executed can be challenged or set aside by a New York court, regardless of whether both parties agreed to the terms. Grounds for challenge include fraud, duress, overreaching, or fundamental unfairness. The acknowledgment requirement alone, which must follow the formal process used to record a deed under New York law, is a technical hurdle that catches agreements drafted without litigation-minded review.

What a Prenuptial Agreement Can & Cannot Address

New York is an equitable distribution state. Courts divide marital property based on factors such as the length of the marriage, each party’s income, and contributions to the household rather than a strict 50/50 split. A prenuptial agreement lets couples define their own distribution terms rather than leaving those decisions to a court.

A well-drafted agreement can cover a substantial range of financial matters:

• Asset classification: Defining how property acquired during the marriage will be categorized
• Spousal maintenance: Establishing the amount and duration of support in the event of divorce

There are real limits, though. Child custody and child support terms in a prenuptial agreement aren’t automatically binding. New York courts retain jurisdiction over those issues and decide them based on the child’s best interests at the time of any dispute. An agreement also can’t include provisions that would leave a spouse unable to support themselves and likely to become a public charge, which is prohibited under New York General Obligations Law Section 5-311.
