Trial & Appellate Experience in Complex Criminal Cases
Attorney John J. Gilsenan has served as lead counsel in close to 100 trials and handled more than a dozen appeals. His experience includes cases involving murder, conspiracy, drug trafficking, public corruption, internet crimes, COVID program fraud, and DUI/DWI.
Before entering private practice, John served as a federal and state public defender in rural Maryland and upstate New York. That background is relevant when allegations involve several defendants, overlapping witness accounts, electronic evidence, or claims that one person is legally responsible for another’s conduct.
What Happens After an Arrest in Rochester
Early intervention can matter before prosecutors present a felony case to a Grand Jury, the body that decides whether sufficient evidence exists to issue an indictment. We use this stage to examine the allegations and seek a reduction or dismissal when supported by the facts and law.
Rochester City Court hears misdemeanors and lesser offenses and conducts felony arraignments. A felony arraignment is the initial court appearance, when the accused hears the charges and the court addresses release or bail. Monroe County Court handles criminal matters and has authority to conduct felony trials.
We defend cases in Rochester City Court, Monroe County Court, and the U.S. District Court for the Western District of New York. State charges are prosecuted by the district attorney in the county where the alleged offense occurred. Federal charges are brought by the U.S. Attorney’s Office for the Western District of New York.
Case Review & Defense Development
Criminal cases generally proceed through court appearances, review of the prosecution’s evidence, negotiations, and, when necessary, trial or appellate proceedings. Our early work includes identifying the conduct attributed to each defendant and assessing whether witness statements, video, digital communications, or other evidence support the prosecution’s account.
In violent-crime cases, we also evaluate self-defense and justification. Justification applies when the circumstances permit the use of physical force under New York law. Its availability depends on the specific facts, including what occurred before and during the encounter.
