How a Federal Criminal Case Proceeds

A federal prosecution can begin long before an arrest and continue through investigation, grand jury proceedings, arraignment, pre-trial litigation, plea negotiations or trial, sentencing, and appeal. Each stage presents distinct decisions for defendants and their families.

That term increases to seven years if the firearm is brandished and ten years if it’s discharged. The sentence is served consecutively to the sentence for the underlying offense, and probation isn’t available for a conviction under that section.
