DWI Charges We Defend
Our attorneys have defended clients against all types of DWI charges, including those involving:
- First-Offense DWI. A BAC of 0.08% or higher is charged as a misdemeanor in New York. A conviction still means a criminal record, license revocation, mandatory ignition interlock, fines, and the possibility of jail time.
- Aggravated DWI. A BAC of 0.18% or higher elevates the charge to Aggravated DWI, carrying steeper fines, longer revocation periods, and greater sentencing exposure.
- Felony DWI. A second DWI within 10 years is charged as a felony. A third offense is as well. Felony DWI carries state prison exposure, substantial fines, and a permanent record.
- DWAI. A BAC between 0.05% and 0.07% can support a Driving While Ability Impaired charge. This is a traffic infraction, but one that still carries license penalties, fines, and points.
- Underage DWI / Zero Tolerance. New York's Zero Tolerance Law applies to drivers under 21 with a BAC between 0.02% and 0.07%. These cases proceed through DMV administrative channels but can have lasting consequences for a young person's license and record.
- DWI with a Child Passenger. Under Leandra's Law, driving while intoxicated with a passenger under 16 is a standalone felony charge, regardless of prior record.
- DWI Causing Injury or Death. When a crash results in serious physical injury or death, charges can escalate to Vehicular Assault or Vehicular Manslaughter, with significant prison exposure.
- Commercial Driver DWI. CDL holders face a lower legal threshold of 0.04% and potential permanent loss of their commercial license.
